Reporting to Legal Counsel, the successful candidate will be primarily responsible for ensuring NH is compliant with Ontario's Personal Health Information Protection Act (PHIPA) and its Freedom of Information and Protection of Privacy Act (FIPPA) and for establishing and promoting privacy and access to information best practices throughout the organization. The position is responsible for the development and delivery of privacy training programs and tools for NH PHIPA agents. Must be knowledgeable regarding health privacy principles, PHIPA more specifically, access to information legislation, FIPPA (ideally) and/or the Municipal Freedom of Information and Protection of Privacy Act, expectations of the Information and Privacy Commissioner of Ontario (IPC) and act as an expert resource on privacy and freedom of information (FOI) matters. The successful candidate will establish, maintain and revise relevant NH privacy/FOI policies, practices and protocols and liaise with the IPC.

RESPONSIBILITIES:
o Ensures that NH is compliant with all applicable privacy and FOI legislation
o Promotes awareness of privacy and FOI programs and services to internal and external stakeholders
o Develops and oversees process for addressing privacy complaints and inquiries
o Investigates privacy breaches and incidents and recommends corrective action
o Develops and maintains statistical framework for tracking all access and privacy requests and prepares annual privacy and freedom of information reports
o Manages, coordinates and conducts privacy auditing and monitoring activities
o Manages and contributes to the development and administration of NH privacy and FOI framework, policies and procedures
o Acts as a subject matter expert to NH management for organizational projects and conducts privacy impact assessments as required. NOTE: NH is in the process of implementing a new health information system and depending on internal resources this position may be required to devote a significant proportion of their time to this project.
o Assesses program-wide and institution-wide issues that need to be modified in light of changes to legislation or regulation, IPC orders and/or guidance documents
o Processes all FOI and complex privacy access requests and ensures all requests are responded to within legislative timelines
o Conducts contract review for privacy and FOI related clauses

QUALIFICATIONS:
o University degree, business, law, health administration or information/records management preferred or a combination of education and professional experience
o Minimum 3-5 years related experience in the privacy/FOI field
O Awareness of, and demonstrated interest in, privacy and access policy, trends and legislative reform
o Privacy Certification from recognized association for privacy and freedom of information professionals (IAPP Canadian Certification (CIPP/C) preferred
o Certified in Health Information Management preferred
o Hospital or healthcare experience preferred
o Experience with health research and quality improvement initiatives is an asset
o Evidence of effective customer service, relationship management, organizational, interpersonal, communication (both verbal and written), leadership, collaboration, judgment, critical thinking and decision-making skills
Tact and diplomacy
o Ability to work effectively within a multi-disciplinary team with representatives from all levels of the organization
o Flexible, self-directed and able to work effectively with minimal supervision
o Consistent and regular attendance required
o Vaccines (COVID-19 and others) are a new hire requirement of the job unless you have an exemption based on medical or on a ground pursuant to the Ontario Human Rights Code
