TMS LLP is a 36 year corporate commercial law firm located in Mississauga looking for a full time associate lawyer.

The lawyer will be expected to practice in the civil litigation area and will be managing shareholder and commercial litigation files, employment law disputes, contract disputes, partnership disputes, mortgage remedy work and occasionally estate litigation.

Required Knowledge, Skills and Abilities

  • Law Degree from recognized Canadian Law School or equivalent.
  • Licensed in good standing with the Law Society of Ontario
  • Strong analytical skills to assess the applicability of legal principles and relevance of evidence.
  • Strong research skills.
  • Strong interpersonal skills.
  • Excellent organizational, administrative and time management skills.
  • Demonstrated ability to work independently and in a team environment.
  • Excellent written communication skills including the ability to prepare a variety of materials including, letters and memos of law.
  • Proficient in the use of internet, word processing and email applications.
  • Proficient in use of PCLaw, ACL, OneKey, Caselines, Microsoft Teams, & Zoom.
  • Proficiency in docketing and legal accounting;
  • Ability to work independently.
  • Adaptability and attention to detail.
  • Strong critical thinking, interpersonal, public speaking skills.
  • Ability to negotiate, research, and communicate verbally and in writing effectively.
  • Experience in civil litigation (min 3 years) strongly desired.
  • Preparing legal correspondence such as: Notices of Action, Statements of Claim, Statements of Defence, Notices of Application, Affidavits, Motion Records, Pleadings, Factums, and Mediation Briefs.
  • Ability to appear in Small Claims Court, Ontario Court of Justice, the Superior Court of Justice, and the Federal Court
  • Retaining clients, independently performing consultations, and managing litigation files including diarizing deadlines and communicating status updates to clients.
  • Liaising with clients, court houses, and other law firms via email and telephone.
  • Assist with form business development and marketing strategies.

Duties and Responsibility

  • Communicating with clients to learn about their legal needs and concerns and providing them with legal advice.
  • Thoughtful analysis of available legal options to clients and possible outcomes and risks
  • Developing strategies to resolve cases favorably and cost-effectively for client using ethical solutions to legal matters.
  • Forging ongoing business relationships with existing and new clients
  • Developing arguments and representing clients in civil legal proceedings.
  • Preparing legal court documents, such as statement of claims, application and motion records, mediation briefs and settlement proposals.
  • Handling of all aspects of the litigation file carriage and manage a variety of other file management tasks and work.
  • Staying informed about current legislation relevant to the firm’s area of practice.
  • Ability to work both independently and within a team-oriented environment;
  • Ability to take initiative as required;
